Leasehold vs Freehold in Kaba Kaba

Two Certificates, One Private Contract

A Hak Milik certificate sits on Indonesia's land register, BPN, filed under Article 21 and Article 9 of the UUPA. It stays closed to a foreign national no matter how long they have lived here.

Hak Sewa works nothing like it. It is a private, notarised contract giving the right to use someone else's land, and it never touches a BPN register at all, per Bali Property Rules.

This split carries through to who signs the paperwork too. A PPAT, the land-deed official, is the only person authorised to draft a deed that transfers or grants HGB or Hak Pakai, both rights recorded at the land office.

A Hak Sewa agreement usually sits with a Notaris instead, the same official who handles preliminary agreements and PT PMA paperwork, per The Bali Lawyer. Ask which one drafted your contract before you sign it.

What Kaba Kaba's Own Prices Leave Out

The only two land parcels Bali Exception had on offer in September 2026 worked out to roughly IDR 196,000,000 to IDR 360,000,000 per are, back-calculated from prices the agency quotes in US dollars. Neither listing states whether that land sits under Hak Milik or a lease.

The villa listings carry the same gap. A two-bedroom opened at USD 176,052 and the largest estate topped out near USD 875,000, yet not one asking price names a tenure.

A leasehold quote and a freehold-equivalent quote sit in the same column here, unsorted. The number alone tells you nothing about which route stands behind it.

The Extra Cost a Freehold Route Carries

Money is where the two routes actually separate. Buying into Hak Milik, or into HGB through a PT PMA, triggers BPHTB, a transfer duty charged at 5% of the transaction value and collected by kabupaten and kota governments, per Bapenda DKI Jakarta's explainer of the national rule.

Hak Sewa involves no transfer of a registered right at all, since it stays a private lease between two parties, so that duty simply never applies to it. A PT PMA route also carries its own paid-up capital and investment plan on top of the duty above.

Matching the Tenure to the Buyer

A straightforward holiday villa or long-stay rental usually points toward Hak Sewa. There is no price floor and no residency requirement, just a lease term negotiated directly with the landowner.

Hak Pakai suits a KITAS or KITAP holder who wants to hold the property personally, above the regulated price floor. A PT PMA holding HGB fits a buyer running a rental business rather than a family home.

Whichever route fits, get it named in writing before you pay a deposit. The villa stock sampled for this site does not name one at all, so ask before you offer.
